Order On order of the Court, the application for leave to appeal is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this matter to the Washtenaw Circuit Court for a determination of (1) whether defendant Temple properly accepted the mediation evaluation pursuant to MCR 2.403(L), and (2) whether the plaintiffs' attempted conditional acceptance was an improper response that should be treated as a total rejection of the evaluation. If the Washtenaw Circuit Court answers the first question in the negative, regardless how it answers the second question, it shall set aside the judgment of March 18, 1993. If the court answers the first question in the affirmative and the second question in the negative, it shall confirm the judgment. If the court answers both questions in the affirmative, it shall give the plaintiffs another opportunity to file a proper written response to the mediation evaluation. We do not retain jurisdiction.
